Diffuse Conventionality Control in Bolivia: Successes, Failures and Pending Issues
Main Article Content
Abstract
This paper addresses the development of Diffuse Conventionality Control. To this end, a jurisprudential review of the rulings of the Inter-American Court of Human Rights and the Plurinational Constitutional Tribunal was conducted, with the aim of systematizing the standards generated and, based on this, analyzing the successes, shortcomings, and unresolved issues of this hermeneutic exercise. The problem is approached from a qualitative perspective, employing deductive, analytical, and synthetic methods; additionally, a document review technique was applied, covering relevant doctrine, legislation, and case law. All of this made it possible to reveal the successes, shortcomings, and pending issues in the jurisprudential body of the PCT.
